Terms of Service

1. The service

Whispernight lets you create videos with sound from text descriptions and reference images using AI models provided by third parties. By creating an account or using the service you agree to these terms.

2. Your account

You sign in with an email verification code or a Google account. You are responsible for activity under your account and for keeping access to your email and Google account secure.

We may suspend or close accounts that break these terms or put the service or other users at risk.

3. Wallet and billing

Generations are paid from a prepaid wallet. You add funds with a card through Stripe; we never see or store your full card number. The minimum top-up is $10.

Each generation is charged to your wallet at the model's current price. If a generation fails, its charge is returned to your wallet. Wallet funds are not cash and cannot be transferred. For billing questions or refund requests, contact us.

4. Your content

You keep the rights you have in the descriptions and images you upload and in the videos you create. You give us the permission needed to store and process them, and to send them to our model providers, in order to run the service for you.

You must have the right to use everything you upload. Do not upload images of people without their consent. Each time you generate a video from images you confirm that you own them or have permission to use them, and that everyone shown is 18 or older and has agreed to appear in an AI-generated video; we keep a record of that confirmation. Videos made from images of real people without their consent are removed and the account is closed.

5. Acceptable use

Do not use Whispernight to create content that is illegal, sexualises minors, harasses or impersonates real people, infringes others' rights, or is meant to deceive. Do not attempt to break, overload or get around the limits of the service. Providers may refuse requests that break their own policies.

Content depicting anyone under 18 is not allowed on Whispernight, whether sexual or not. Violations may lead to account suspension.

6. Availability

We work to keep the service available, but it depends on third-party providers and may change, slow down or be interrupted. Models, prices and features may change over time.

7. Disclaimer and limitation of liability

The service and its outputs are provided as is. AI output can be inaccurate or unexpected, and you are responsible for how you use it. To the extent the law allows, our liability for any claim is limited to the amount you paid us in the 12 months before the claim.

8. Changes

We may update these terms. The date at the top shows the latest version; continuing to use the service after a change means you accept it.
